It is trying to act illegally.<br /><br />The Lisbon Treaty is treaty between the member states, hence only member states can alter it. It is not Europeans Council’s bussines at all.<br /><br />Today’s European Council can’t speak on behalf of the European Council under the Lisbon Treaty – that’s different legal entity.<br /><br />The only way to alter the conditions of the Lisbon Treaty before it comes into force is to modify the Lisbon Treaty itself or to append a new treaty to it.
