State of the Union: European Solidarity Corps

There are no new visible updates on the European Commission’s State of the Union 2017 web page, still only in English.

We turn to the State of the Union 2017 brochure, where the next section is called The European Solidarity Corps: One Year on (from page 89). By 2020:

The aim is to have 100,000 young people taking part in the European Solidarity Corps. To achieve this ambition, the Commission proposed in May 2017 to give the European Solidarity Corps a budget of more than €340 million for the next three years, and to extend the types of activities.  

Among the factsheets on the State of the Union, you can find an almost identical one on the European Solidarity Corps, but available in all 24 official EU languages.
Through the European Youth Portal you can find more information about the European Solidarity Corps, two to twelve months long volunteer work projects for young people between 18 and 30 years old.


Official documents

After president Juncker’s State of the Union 2016 speech,  the Commission published the communication A European Solidarity Corps COM(2016) 942 final in December.

Under the procedure number 2017/0102 (COD) you can find the proposed regulation laying down the legal framework of the European Solidarity Corps etc. COM(2017) 262 final, as well as the  documents accompanying the 30 May 2017 proposal.

Europe 2020 strategy: Flagship initiative Youth on the move

Education is at the heart of the Europe 2020 flagship initiative Youth on the move, which aims at improved employability and employment for young EU citizens.



Context



The Europe 2020 strategy puts forward three priorities for growth (smart, sustainable and inclusive), and five headline targets (employment, innovation, climate and energy, education and inclusion).



The Commission has promised and the European Council has called for concrete action in the form of seven flagship initiatives.



Flagship initiative Youth on the move

We are now taking a look at how the European Commission has sketched the flagship initiative Youth on the move, in its policy proposal:

The executive summary of the Europe 2020 strategy offers a brief description of what the flagship initiative is about (page 5):


– "Youth on the move" to enhance the performance of education systems and to facilitate the entry of young people to the labour market.



Education, mobility and employment

On page 13, the Commission outlines how the flagship initiative Youth on the move aims to improve education (employability), increase mobility in education and training, and facilitate job market entry for young people. Action is foreseen at EU level and at national level:


The aim is to enhance the performance and international attractiveness of Europe's higher education institutions and raise the overall quality of all levels of education and training in the EU, combining both excellence and equity, by promoting student mobility and trainees' mobility, and improve the employment situation of young people.

At EU level, the Commission will work:

– To integrate and enhance the EU's mobility, university and researchers' programmes (such as Erasmus, Erasmus Mundus, Tempus and Marie Curie) and link them up with national programmes and resources;

– To step up the modernisation agenda of higher education (curricula, governance and financing) including by benchmarking university performance and educational outcomes in a global context;

– To explore ways of promoting entrepreneurship through mobility programmes for young professionals;

– To promote the recognition of non-formal and informal learning;

– To launch a Youth employment framework outlining policies aimed at reducing youth unemployment rates: this should promote, with Member States and social partners, young people's entry into the labour market through apprenticeships, stages or other work experience, including a scheme ("Your first EURES job") aimed at increasing job opportunities for young people by favouring mobility across the EU.

At national level, Member States will need:

– To ensure efficient investment in education and training systems at all levels (pre-school to tertiary);

– To improve educational outcomes, addressing each segment (pre-school, primary, secondary, vocational and tertiary) within an integrated approach, encompassing key competences and aiming at reducing early school leaving;

– To enhance the openness and relevance of education systems by building national qualification frameworks and better gearing learning outcomes towards labour market needs.

– To improve young people's entry into the labour market through integrated action covering i.a guidance, counselling and apprenticeships.


In the overview annex, the flagship initiative Youth on the move is placed under Smart growth and Education (page 32).



Headline target: Education




The European Council meeting 17 June 2010 finalised the headline targets (document EUCO 13/10). The adopted headline targets guide the preparation of the flagship initiatives (and the national reform programmes, NRPs). The approved education target of the Europe 2020 strategy for jobs and growth aims at (in Annex I, page 12 of the conclusions):


- improving education levels, in particular by aiming to reduce school drop-out rates to less than 10% and by increasing the share of 30-34 years old having completed tertiary or equivalent education to at least 40%; [The European Council emphasises the competence of Member States to define and implement quantitative targets in the field of education.]

European Observatory on Counterfeiting and Piracy

The Commission aims to ensure that a truly efficient and proportionate system of enforcement of intellectual property rights exists, both within and outside the internal market, said the press release of 14 December 2009 (IP/09/1919).

Already the European Union already has the directive known as IPRED in place, providing for the (civil) measures, procedures and remedies necessary to ensure the enforcement of intellectual property rights (including industrial property rights):

European Observatory on Counterfeiting and Piracy




However, the European Commission is far from content with progress this far.

Last Spring, the European Observatory on Counterfeiting and Piracy was created to spread the best enforcement techniques to combat infringements of intellectual property rights.

Little public information of substance exists about the Observatory, but it is administered by the Commission’s internal market services and designed to join national public officials as well as representatives of IP rights holders experienced in IPR enforcement (designated as stakeholders).

Despite token consumer representation, citizens, consumers and net users, especially youth, mainly seem to have been cast into the role of receivers of awareness and education campaigns.



This meeting report from the sub-group on the legal framework, by the European Communities Trade Mark Association (ECTA), sheds some light on representation and work within the Observatory. The consumer representative (BEUC) was not present, but the following were represented:

Business Action to Stop Counterfeiting and Piracy (BASCAP; ICC), Union des Fabricants (Unifab, the French anti-counterfeiting and IPR protection association), Istituto di Centromarca per la lotta alla contrafazzione (Indicam; Italian anti-counterfeiting association), the Motion Picture Association, the International Federation of the Phonographic Industry (IFPI), the Business Software Alliance (promoting IPR protection for the software industry) and (national) representatives of the Global Anti-Counterfeiting Group (GACG) Network.


There is nothing wrong in business associations lobbying openly for their interests during the process of creating regulation, but it becomes problematic when one angle – increasing and enforcing monopoly rights - becomes the driving force behind the public EU Commission machinery, which is supposed to shape balanced rules taking all interests into account.

With an input mechanism totally dominated by IPR enforcement interests, there seems to be practically no real voice for citizens, net users or consumers with an interest in the free flow of information.

The same pattern is discernible in legislative initiatives in EU member states such as France, Spain and the United Kingdom.

Good public policy should build on the markets as much as on the marketeers.

European Union: Education and youth plus sport

The European Community (European Union) encourages cooperation between the member states in the areas of education and youth exchange. The Lisbon Treaty adds sport and embellishes youth.

There is no denying the importance of sport, from many angles, but lobbyists and lawyers can rejoice that the Lisbon Treaty is not content with the addition, but refers to the specific nature of sport. This is an open invitation to special pleading, of which we have already seen vigorous signs.

Although the Community (Union) powers are puny, the education sector hosts some of the most popular European mobility programmes.

Article 149 TEC

Chapter 3 Education, vocational training and youth starts with Article 149 TEC (ex Article 126) setting out European Community (European Union) aims and activities in the policy areas education and youth.

The current Article 149 of the Treaty establishing the European Community (TEC), as published in the latest consolidated version of the treaties, OJ 29.12.2006 C 321 E/112–113:

CHAPTER 3
EDUCATION, VOCATIONAL TRAINING AND YOUTH

Article 149 TEC

1. The Community shall contribute to the development of quality education by encouraging cooperation between Member States and, if necessary, by supporting and supplementing their action, while fully respecting the responsibility of the Member States for the content of teaching and the organisation of education systems and their cultural and linguistic diversity.

2. Community action shall be aimed at:

— developing the European dimension in education, particularly through the teaching and dissemination of the languages of the Member States,

— encouraging mobility of students and teachers, by encouraging inter alia, the academic recognition of diplomas and periods of study,

— promoting cooperation between educational establishments,

— developing exchanges of information and experience on issues common to the education systems of the Member States,

— encouraging the development of youth exchanges and of exchanges of socioeducational instructors,

— encouraging the development of distance education.

3. The Community and the Member States shall foster cooperation with third countries and the competent international organisations in the field of education, in particular the Council of Europe.

4. In order to contribute to the achievement of the objectives referred to in this Article, the Council:

— acting in accordance with the procedure referred to in Article 251, after consulting the Economic and Social Committee and the Committee of the Regions, shall adopt incentive measures, excluding any harmonisation of the laws and regulations of the Member States,

— acting by a qualified majority on a proposal from the Commission, shall adopt recommendations.

Original Lisbon Treaty (ToL)

Although the Treaty of Lisbon is unreadable on its own, it spells out how the current treaties are amended.

Article 2, point 123 of the original Treaty of Lisbon (ToL) tells us that Chapter 3 becomes the new Title XI Education, vocational training, youth and sport(OJ 17.12.2007 C 306/82):

EDUCATION, VOCATIONAL TRAINING, YOUTH AND SPORT

123) Chapter 3 shall be renumbered TITLE XI and the words ‘AND YOUTH’ at the end of the
heading shall be replaced by ‘, YOUTH AND SPORT’.

124) Article 149 shall be amended as follows:

(a) in paragraph 1, the following subparagraph shall be inserted:

‘The Union shall contribute to the promotion of European sporting issues, while taking account of the specific nature of sport, its structures based on voluntary activity and its social and educational function.’;

(b) in paragraph 2, fifth indent, the words ‘and encouraging the participation of young people in democratic life in Europe,’ shall be added at the end; the following shall be inserted as the last indent:

‘— developing the European dimension in sport, by promoting fairness and openness in sporting competitions and cooperation between bodies responsible for sports, and by protecting the physical and moral integrity of sportsmen and sportswomen, especially the youngest sportsmen and sportswomen.’;

(c) in paragraph 3, the words ‘and sport’ shall be added after ‘in the field of education’;

(d) in paragraph 4, the words ‘the Council’ shall be deleted from the introductory phrase and the first indent shall begin with the words ‘the European Parliament and the Council, acting’; the second indent shall begin with the words ‘the Council, on a proposal’.

Convention and Constitution

European sporting issues and the European dimension in sport are the main novelties. The additions come from Article III-282 of the Treaty establishing a Constitution for Europe, word for word.

The indent on youth exchange was embellished with encouragement of the participation of young people in democratic life in Europe. Nice, to the extent there can said to be such life at European level, this addition too was taken over from Constitution Article III-282.

Like most of the ‘innovations’ of the Constitutional Treaty, these are based on the proposals of the European Convention in the draft Treaty establishing a Constitution for Europe, although the intergovernmental conference added the reference to the specific nature of sport, its structures based on voluntary activity…

Renumbering ToL

The Table of equivalences of the original Treaty of Lisbon tells us that the Chapter 3 on education, vocational training and youth was first to become Title XI Education, vocational training, youth and sport, but renumbered Title XII in the consolidated version.

Article 149 TEC first became Article 149 TFEU (ToL), then renumbered Article 165 TFEU in the consolidated versions of the amending treaties (OJ 17.12.2007 C 306/217).

Consolidated Lisbon Treaty

After the explicit amendments, horizontal amendments and renumbering, Article 165 of the Treaty on the Functioning of the European Union (TFEU) appears as follows in the consolidated TFEU, published in the Official Journal of the European Union, OJ 9.5.2008 C 115/120–121:

TITLE XII
EDUCATION, VOCATIONAL TRAINING, YOUTH AND SPORT

Article 165 TFEU
(ex Article 149 TEC)

1. The Union shall contribute to the development of quality education by encouraging cooperation between Member States and, if necessary, by supporting and supplementing their action, while fully respecting the responsibility of the Member States for the content of teaching and the organisation of education systems and their cultural and linguistic diversity.

The Union shall contribute to the promotion of European sporting issues, while taking account of the specific nature of sport, its structures based on voluntary activity and its social and educational function.

2. Union action shall be aimed at:

EU competence

Having looked at the powers of the European Union in the areas of education, youth and sport, as set out by the Treaty of Lisbon, it might be helpful to recall the general TFEU provisions on categories and areas of Union competence.

Article 2 TFEU presents the main characteristics of exclusive competence and shared competence before the description in Article 2(5) TFEU:

5. In certain areas and under the conditions laid down in the Treaties, the Union shall have competence to carry out actions to support, coordinate or supplement the actions of the Member States, without thereby superseding their competence in these areas.

Legally binding acts of the Union adopted on the basis of the provisions of the Treaties relating to these areas shall not entail harmonisation of Member States' laws or regulations.

Article 6 TFEU

The policy areas are then formed into rough groups in the following Articles. Here we are interested in Article 6 TFEU. Education, vocational training, youth and sport are mentioned among the areas, where the EU supports, coordinates or supplements member states’ actions:

Article 6 TFEU

The Union shall have competence to carry out actions to support, coordinate or supplement the
actions of the Member States. The areas of such action shall, at European level, be:

(a) protection and improvement of human health;

(b) industry;

(c) culture;

(d) tourism;

(e) education, vocational training, youth and sport;

(f) civil protection;

(g) administrative cooperation.
